Is this a legal Legends Tire?

I just want your opinion - is this a legal Legends Tire? (For Discussion only)  

Tread Depth - When the top of the wear-bar indicator appears at two spots in a row on the tire (side-by-side or in the same groove - i.e. outside groove) or the tread depth is 2/32” or less on any two (2) points in the tread (measured from the bottom of the groove, not at the top of the wear-bar) (“tread” will be defined as 6” across the tire, to be measured from the center 3” both ways), that tire will be confiscated, destroyed or drilled by the technical inspector. There is no disqualification for violation of this rule unless more than one tire is below the minimum tread depth. If this rule is violated on two different occasions at the same event or two tires on the car at the same time, then that driver will be disqualified. If the wear bar is cut out or tampered with, that tire shall be destroyed immediately (even if it has more than 2/32” tread on it) and a disqualification will be applied.

For this discussion, with only the evidence provided to me in this fashion to base it on, yes, it is a legal tire in my opinion

Reason #1
Per rule quoted: "There is no disqualification for violation of this rule unless more than one tire is below the minimum tread depth."
I only see one tire.

Reason #2
Per rule quoted: "If this rule is violated on two different occasions at the same event..."
I don't have the information needed to determine how many times it was checked at a specific event.

Reason #3
Per rule quoted: "...or two tires on the car at the same time, then that driver will be disqualified."
I only see one tire.

No. It is illegal.

VMS is right as to disqualification, but that doesn't mean the tire is legal. the tire is illegal because the wear bears are flat. HOWEVER, if this was the only tire like this, the proper result would be the Tech official drilliing the sidewall, but no DQ of the racer.

OK when I was in Florida this year for the winter nationals this is what they said. They have decided not to enforce the tire rule because of the number of complaints about how many races they are getting out of a tire. Did they put it in writing? NO Did they republish the rule book? NO This is what was told to me by Scott. I had tires on that were almost slick and they let me go right on through. IS it right? Well I guess it depends on how you want to look at it. They were letting everyone through on the same tire so I had no problem with it.
I still say give a HARD narrow slick and we all be better off but that is a whole separate discussion.

The tire rule was modified to its current state. This tire is illegal and could be drilled. Should the other right side tire look similar in tech, the racer would be dq'd and the tires cold be drilled.

To finish the tire story - this tire was deemed as illegal by the track INEX Inspector and the driver was told not to return to the track with this tire. The tire was not confiscated, destroyed or drilled by the technical inspector and it could have return to the track on another car  or the same car ( it was not marked or identified in any way.) The other three tires were deemed legal. The driver did the right thing....by actually replacing both right tires with new camber cut tires and won the next weeks main event.
